Kiwi Bank Faces Allegations of Overcharging Exceeding $7 Million, Violating Fair Trading Act
The New Zealand Commerce Commission has criminally charged Kiwi Bank for alleged violations of the Fair Trading Act. These allegations are related to overcharging exceeding $7 million over several years for more than 36,000 customers, concerning home loans, credit card fees, and late payment interests.
In a statement, the Commerce Commission revealed that the bank is in contact with affected customers and is progressively working on refunding the overcharged amounts. A representative attributed the issue to manual and electronic system errors within Kiwi Bank, describing it as a longstanding breach of the Fair Trading Act.
Furthermore, the Commission has demanded loan agencies to streamline processes to ensure consumers receive the advertised amounts and urged banks to invest in systems to appropriately serve consumers.
The current case pertains to excessive charges since 2019, and as legal proceedings are ongoing, the Commission has declined further comments.
Kiwi Bank has stated its commitment to thoroughly investigate the matter and resolve the issues. Additionally, they emphasized implementing relief programs for affected customers and pledged to complete all improvement efforts by the end of this year.
