The couple, whose identities remain undisclosed in the tribunal's records, engaged with an individual posing as a property manager named Harry Smith, whom they encountered through a rental listing on TradeMe.

During their visit to view the rental property, the couple noted the presence of other property managers assisting prospective tenants. However, they proceeded with signing the scammer's contract and depositing $2200 as bond and $550 as rent, only to find themselves unable to retrieve the funds.

While they sought recourse through the Tribunal, their case was dismissed on the grounds that it did not constitute a valid tenancy agreement.

This incident serves as a cautionary tale, echoing warnings issued by the Real Estate Institute of New Zealand (REINZ) about the increasing prevalence of such scams targeting both property managers and tenants.

REINZ advises tenants to verify the identity of property managers, conduct independent searches for official contact information of real estate companies, and make direct inquiries via verified office phone numbers to confirm legitimacy. Additionally, it emphasizes the importance of verifying ownership of properties advertised publicly.

Further advice for prospective tenants includes:

1. Verify the identity of property managers or owners.
2. Utilize official communication channels.
3. Exercise caution with unusually low rental prices.
4. Avoid making upfront payments.
5. Ensure the provision of legal documents.
