TSB Bank has been slapped with a fine exceeding $2 million for imposing unreasonable credit and default fees on its customers, a violation of the Credit Contracts and Consumer Finance Act (CCCFA).

The Commerce Commission announced that TSB breached the CCCFA, leading to a court case that resulted in a $2.47 million penalty. This legislation mandates that financial institutions charge fair and transparent fees.

Following the revelation of these violations, TSB has compensated approximately 48,000 affected borrowers with around $6 million and cooperated fully with the Commerce Commission's investigation. The probe revealed that from June 2015 to November 2021, TSB charged unreasonable fees, including some that were not contractually justified.

The presiding judge deemed TSB's prolonged fee imposition as a severe infringement, significantly undermining the purpose of credit contracts. It was also disclosed that a 'system error' led to an overcharge of $3.6 million.

A representative from the Commerce Commission emphasized that this ruling clarifies that lenders cannot charge fees exceeding transaction costs. The fee restriction system is designed to protect borrowers and facilitate comparisons of loan products, requiring financial institutions to regularly review the fairness of their fees.

TSB Bank CEO Kerry Boyle issued a statement acknowledging that the issue originated under previous management. “We discovered the problem through years of internal review and reported it to the Commerce Commission,” Boyle said. He apologized for the inconvenience caused to customers and noted that TSB has improved its programs and refunded both past and current clients. He also confirmed that TSB agreed to pay the $2.47 million fine as part of the settlement.

TSB 은행의 케리 보이엘 CEO는 성명서를 통해 “현재 경영진 이전의 문제로, 수년간의 내부 검토를 통해 문제를 발견하고 상업위원회에 보고했다”며 “고객들에게 불편을 끼쳐 사과드리며, 문제 해결을 위해 프로그램을 개선하고 과거 및 현재 고객에게 환불을 진행했다”고 밝혔다. 그는 또한 TSB가 합의의 일환으로 247만 달러의 벌금을 지불하기로 결정했다고 덧붙였다.
